Well, it's a nice theory, but it falls apart in the first couple of minutes of the episode.

Marco comes in on a broadcast, and tells Murphy about the FCC cracking down on pirate radio stations. This generally starts the whole "I hate Marco" and "Mailbox Head" business. The point is, Marco had been reading news reports, or whatever they get down in Sealab, about the FCC's actions, and him "knowing" about the Hammer (The Hammer? I KNEW IT!) I think is just more of being said jokingly more than anything. I mean, you've got the young FCC guy going, "So we're gonna drop the hammer, right?" and the other saying, "OH YEAH, we're gonna drop the hammer." It's just lame bad-guy dialog, and is funny.

I wouldn't read too much into anything on Sealab =P
